Distance Sales Agreement (Digital Credits)

1. Parties

This agreement is concluded between:

(collectively "Seller")

and the customer purchasing services through the platform ("Buyer").

2. Subject of the Agreement

This agreement regulates the rights and obligations of the parties under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation regarding the sale and delivery of digital credits used to generate technical drawings from facade photos through facadetool.com.

3. Service Features / Digital Credits

• The service generates technical drawings from facade photos using a credit system.
• Each conversion consumes a specified amount of credits (shown before the Buyer confirms the request).
• Credits are digital and are loaded to the Buyer's account after successful payment.
• Credit validity depends on the package and is shown on the pricing/payment page at the time of purchase.
  • If a package has an expiration period, unused credits expire at the end of that period.
  • If a package is marked as "non-expiring/frozen", unused credits do not expire and may remain frozen until the next purchase, then become usable again with the newly purchased credits (as described on the payment page).
• Used credits are non-refundable once the digital service has started.

4. Establishment of the Agreement

The Buyer places an electronic order by selecting a credit package, entering payment information, and confirming the purchase. The agreement is established when the payment is approved.

5. Price and Payment

Prices and any applicable taxes (including VAT where applicable) are shown on the website at the time of purchase. Payment is made through a secure payment provider using credit/debit card. The Seller may issue an invoice/receipt electronically where applicable.

6. Delivery

Credits are delivered digitally. After successful payment, credits are automatically added to the Buyer's account. No physical delivery is provided.

Purchased credits are delivered digitally and instantly added to your account after successful payment. No physical shipment applies.

7. Right of Withdrawal

In accordance with Article 15 of Law No. 6502 and Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for digital content/services where performance starts immediately with the consumer's prior express consent and acknowledgment of loss of withdrawal right.

By completing the purchase, the Buyer requests instant delivery/performance and acknowledges that the right of withdrawal is not applicable once performance begins.

8. Personal Data Protection

Personal data is processed in accordance with the Turkish Personal Data Protection Law No. 6698 (KVKK). Please refer to the KVKK Information Notice and Privacy Policy on the website.

9. Dispute Resolution

For refund/cancellation or other disputes:

• If unresolved, the Buyer may apply to Consumer Arbitration Committees (monetary limits updated annually) and/or Consumer Courts in accordance with applicable law.

10. Enforcement

The Buyer is deemed to have accepted this agreement electronically. This agreement enters into force upon payment approval.
